The Home Office have just announced plans to increase the penalties for being found with illegal migrants living in a rented property. Fines for landlords are currently £1,000 for each illegal occupier, for a first offence and £3,000 for a repeat offence within three years.
These figures are proposed to increase to £10,000 for the first offence and £20,000 for a repeat offence within three years.
The law does not have a penalty for not having checked a tenant’s right to rent, but doing a proper right to rent check give a “statutory defence” to the penalty. This increase in penalties makes having quality systems for checks and documents more important.
It is planned that legislation will be passed to makes these changes, effective from the beginning of 2024.
