The Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022

On 6 June 2022, we published an article to confirm draft regulations had been written to amend The Smoke and Carbon monoxide Alarm Regulations 2015. These regulations have been published.

From 1 October 2015, it was a landlords requirement to ensure that there was a proper working smoke alarm in a property on every floor that has living accommodation for any tenancy that began on or after this date. This still remains the same, but now the landlord also needs to provide a carbon monoxide alarm, where there is a fixed combustion appliance (excluding a gas cooker).

Also from 01 October 2022, If a tenant reports an alarm is faulty the landlord must investigate the fault and repair or replace the alarm if required. 

If a landlord fails to comply with a remedial notice that has been served by the local authority, they could incur a fine of up to £5,000.
