Further to the information update provided over last weekend the Government produced new legislation on the 1 September that came into force on the 2 September, barely twelve and a half hours’ notice was given!

On the 2 September 2020 the government released The Assured Tenancies and Agricultural Occupancies (Forms) (England) (Amendment) and Suspension (Coronavirus) Regulations 2020. These regulations prescribed a new Form 6A, section 21 notice. As of 2 September 2020 when serving a section 21 no fault eviction notice to your tenants you should only use this form, at least until 31 March 2021 under current rules.

The previous Form 6a was valid for six months from the date of service, however, now the amended Form 6A is valid for ten months from the date of service. Six months’ notice must be given to your tenants and then the landlord has a further four months to submit possession paperwork to court.

Owing to an uncertainty of the validity of the notice issued on the 29 September it may be advisable to consider reserving any notice issued after 28 September to make sure it is the correct one.
